Lumen8 Labs ("Lumen8 Labs," "we," "us," or "our") operates the website located at lumen8labs.com (the "Site") and provides AI consulting and implementation services (the "Services"). This Privacy Policy describes how we collect, use, disclose, and protect information about you when you visit our Site, submit information through our forms, or otherwise interact with us.

By using the Site or providing information to us, you agree to the practices described in this Privacy Policy.

1. Information We Collect

Information You Provide Directly

When you fill out a form on our Site, request a consultation, book an appointment, or otherwise communicate with us, we may collect:

• Name
• Email address
• Phone number
• Company name and job title
• Information about your business and project needs that you choose to share
• Any other information you voluntarily provide in messages or form fields

Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information through cookies, pixels, and similar technologies, including:

Some calls may be answered or placed by an automated AI voice assistant; these calls may be recorded and transcribed for quality, training, and record-keeping purposes. Where required by law, you will be notified of recording at the start of a call.

2. How We Use Your Information

We use the information we collect to:

• Respond to your inquiries and provide the Services you request
• Schedule, confirm, and manage appointments and consultations
• Communicate with you by email, phone, and text message (as described in Section 3)
• Operate, maintain, analyze, and improve the Site and the Services
• Personalize your experience and measure the effectiveness of our marketing
• Maintain business records and manage our customer relationships
• Protect against fraud and abuse, and comply with legal obligations

3. Text Messaging (SMS) Terms and Consent

If you provide your phone number and consent to receive text messages from Lumen8 Labs (for example, by checking the SMS consent box on one of our forms), you agree to receive text messages from us related to your inquiry, appointments, service updates, and, where you have consented, marketing communications.

• Consent is not a condition of purchase. You may use our Services without agreeing to receive text messages.
• Message frequency varies. Message and data rates may apply depending on your mobile carrier and plan.
• Opt out at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and no further texts. Reply HELP for assistance, or contact us using the information in Section 12.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with, or sold to, any third party. Information may be shared with subcontractors and service providers solely to support the delivery of messages to you (for example, our messaging platform provider).

4. Phone Calls and AI Voice Assistants

With your consent, we may contact you by phone, including through calls placed or answered by an automated AI voice assistant, regarding your inquiry, appointments, and the Services. Our AI assistant will identify itself as an automated assistant at the beginning of the call. You may request to speak with a human, or ask not to be called again, at any time during any call, or by contacting us using the information in Section 12.

5. How We Share Information

We do not sell your personal information. We share information only in the following circumstances:

• Service providers. We use third-party providers to operate our business, including customer relationship management (CRM) and marketing automation platforms, communications and telephony providers, AI voice and transcription providers, web analytics providers, scheduling tools, payment processors, and website hosting and infrastructure providers. These providers process information on our behalf and are permitted to use it only to provide services to us.
• Legal compliance and protection. We may disclose information if required by law, subpoena, or legal process, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
• Business transfers. If Lumen8 Labs is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will take reasonable steps to ensure the continued protection of your information.

For clarity, and as stated in Section 3, mobile phone numbers and SMS opt-in consent are never shared with third parties or affiliates for their own marketing purposes.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, remember preferences, measure Site performance, and understand how visitors use the Site. Most browsers allow you to control cookies through their settings, including blocking or deleting cookies. Disabling cookies may affect some Site functionality. We currently do not respond to "Do Not Track" browser signals, as no industry standard for them has been adopted.

7. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Privacy Policy, including maintaining business records, complying with legal obligations, resolving disputes, and enforcing agreements. Records of SMS consent and opt-outs are retained as required to honor your communication preferences and demonstrate compliance. When information is no longer needed, we delete it or de-identify it.

8. Your Privacy Rights and Choices

Depending on where you live, you may have rights under applicable state privacy laws, which may include the right to:

• Access the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your personal information
• Opt out of certain processing, such as targeted advertising

To exercise any of these rights, contact us using the information in Section 12. We will respond in accordance with applicable law and may need to verify your identity before fulfilling a request. We will not discriminate against you for exercising your privacy rights.

Communication choices: You may unsubscribe from marketing emails using the link in any email, opt out of text messages by replying STOP, and request not to receive phone calls by telling us during a call or contacting us directly.

9. Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Children's Privacy

The Site and Services are intended for businesses and individuals 18 years of age or older. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, please contact us and we will delete it.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and post the updated policy on this page. Material changes may be communicated through additional notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated policy.
